Terms & Conditions
The Gala T & D CompanyUnified Number: 7041321329Jeddah, Kingdom of Saudi ArabiaVersion 1.0 | Effective: 18 August 2026
Please read these Terms carefully before using the Platform. They explain The Gala’s role, Customer and Service Provider rights and obligations, and the booking, payment and cancellation process.
Acceptance and Scope
These Terms govern use of The Gala website, customer app, TheGala Partner and related services. By creating an account, submitting a request, accepting a booking or using any part of the Platform, you confirm that you have read and agreed to these Terms, the Privacy Policy and the booking-specific policies shown before payment.
If you use the Platform for a business, you represent that you are authorised to bind that business. If you do not agree, do not create an account or use the service.
Definitions
“The Gala” or “Platform” means the digital services operated by The Gala T & D Company. “Customer” means the person requesting a service. “Service Provider” means the establishment or independent professional that offers and performs a service. “Offer” means the service description, price, availability and conditions. “Booking” means a request accepted by the Service Provider for which the Customer completes the required payment. “Deposit” means the portion paid through the Platform to secure a Booking when that option is offered. “Booking Policy” means the offer-specific price, payment, cancellation and rescheduling terms displayed before confirmation.
The Gala's Role
The Gala is an intermediary marketplace that helps Customers discover event Service Providers, request services and manage bookings, payments and communications. Service Providers are independent parties, not employees, agents or legal partners of the company. They are responsible for service delivery, quality, safety, licences, personnel, tax and professional obligations.
The Platform may verify selected provider information or documents, but this is not a comprehensive guarantee of suitability or quality. Customers should review the Offer, ratings and requirements before booking. Providers must accurately disclose scope, limitations and charges.
Eligibility and Accounts
A user must have full legal capacity and be at least 18 years old. Users must provide accurate, current information, use their own accounts and protect passwords and verification codes. A user is responsible for activity through the account unless suspected compromise or unauthorised use is reported promptly.
We may require identity, authority, business or payment verification and may limit account features until verification is complete. Misleading identities, impersonation and unauthorised account transfers are prohibited.
Service Provider Registration
A Service Provider must submit accurate and valid information, approvals and documents, including commercial registration, licence, permits, bank and tax details where required. The provider must keep them current, verify the eligibility of its personnel and contractors, and comply with relevant professional, health, safety, municipal and tax requirements.
A provider may be subject to additional commercial terms displayed in TheGala Partner or a Service Provider Agreement. Those terms prevail for commission, settlement, advertising and provider-specific services. These Terms continue to govern Platform use and the relationship with Customers.
Offers, Prices and Availability
A Service Provider must accurately describe each Offer, including components, duration, capacity, service area, equipment, exclusions, extra costs, cancellation policy and availability. Displayed prices must include taxes the provider is required to collect unless a lawful, clear disclosure is made before confirmation.
An obvious price or description error may be corrected before confirmation, with the option to accept the correct price or cancel and receive a refund of amounts paid through the Platform. No undisclosed charge may be imposed after confirmation unless the Customer requests and agrees to an additional item and its price.
Booking Request and Confirmation
The Customer’s request is sent to the Service Provider, who normally has up to 24 hours to accept or reject it unless a different period is shown. A request is not confirmed until the provider accepts and the Customer completes the required payment within the displayed window, normally 24 hours after acceptance. A request may expire automatically if the provider does not respond or payment is not completed on time.
A Booking becomes binding when confirmed status is displayed and notice is sent. Both parties must check the date, time, location, scope, price and cancellation policy and report any discrepancy promptly.
Payment Models
The Platform may offer full payment through the Platform or a Deposit through the Platform with the balance paid directly to the Service Provider by the deadline shown in the Offer. A provider may set the balance due on the service date or 3, 7, 14 or 30 days before it, and the deadline will be shown before Customer confirmation.
For a Deposit Booking, The Gala does not collect or control a balance paid directly to the Service Provider. The Customer should retain payment evidence. The provider is responsible for receiving, invoicing and refunding that direct payment under the Booking Policy and applicable law. The Platform may assist communications but does not become the holder of those funds.
Payment Providers and Instalments
Transactions are handled by independent payment providers and may include MyFatoorah. Tabby or Tamara may be available for some Offers. Approval, credit limits, instalments, charges and late payment are governed by the selected provider’s terms. A payment authorisation does not confirm a Booking unless confirmed status appears. A payment provider may reject a transaction or require additional verification.
Fees, Taxes and Invoices
The price, taxes and any Platform fees charged to the Customer are displayed before payment. Receipts or invoices are issued according to each party’s capacity and applicable tax requirements. The Service Provider is responsible for taxes and invoicing for its service, while The Gala is responsible for any fee it charges itself.
Provider commission, payment gateway or instalment charges and settlement timing are governed by the commercial terms accepted in TheGala Partner or the Service Provider Agreement. A confirmed Booking amount may not be changed without the parties’ agreement and a record in the Booking.
Cancellation and Rescheduling
Cancellation policies vary by Offer and may allow free cancellation until a stated deadline, partial refund or no refund. The policy must be displayed before confirmation and applies to the Customer’s request, subject to mandatory rights. Rescheduling is subject to provider availability and any disclosed price difference or cost.
Platform fees, applicable VAT and payment processing charges are treated as disclosed before payment and as permitted by law. A processing fee is deducted only if it is not returned by the payment provider and the deduction was disclosed and legally permitted. Refunds are made to the original payment method where possible. Posting time varies by the bank, MyFatoorah, Tabby or Tamara.
Provider Cancellation or Failure to Perform
If the Service Provider cancels or fails to deliver the agreed service for a reason not attributable to the Customer, the Customer is entitled to a refund of amounts paid through the Platform for the unperformed part, without prejudice to other statutory rights. Direct payments must be refunded by the provider, and the Platform may help verify facts and facilitate communication.
Where performance or delivery is delayed, rights under the Saudi E-Commerce Law and other applicable laws apply, including rescission when the statutory delay conditions are met, unless the delay is caused by force majeure or another lawful solution is agreed. The provider must promptly notify the Customer and Platform of an expected delay and propose an appropriate remedy.
Service Performance and Home Visits
The Customer must provide accurate information, a safe and accessible location and any site approvals or permits, and must attend or provide a representative at the agreed time. The provider must arrive as agreed and perform the scope professionally and safely. A provider may decline an unsafe or unlawful site, but must document the reason and communicate promptly.
Any extra item, hour or material not included in the Offer must be agreed in writing before it is supplied. The Platform is not responsible for unverified instructions, payments or changes made outside the Booking record, without affecting statutory rights.
Communications and Booking Records
The parties should use Platform chat and approved channels to document material details. The Platform may send confirmations, reminders and status updates by app, SMS, email or WhatsApp. Electronic records may be used as evidence of the transaction, subject to applicable law.
Users must not request or share card details or verification codes, or move full payments outside the designated flow to bypass Platform protections or fees. Suspicious requests should be reported.
Reviews and User Content
A Customer may post an honest review of a completed Booking, and the provider may respond. Content must relate to the experience and must not contain abuse, defamation, discrimination, personal data or third-party intellectual property without a right to use it. A user grants The Gala a non-exclusive licence to use uploaded content to display, operate and market the service until the content is removed or the purpose ends, subject to statutory rights.
We may remove or limit non-compliant content and use review-verification measures, without an obligation to publish every item or conduct comprehensive pre-screening.
Prohibited Conduct
The Platform must not be used for fraud, money laundering or unlawful activity; impersonation; misleading information or reviews; harassment or discrimination; privacy or intellectual property infringement; unauthorised system access, interference or automated extraction; bypassing the booking or payment mechanism; or offering a service the provider is not licensed or capable of performing.
Intellectual Property
The Gala’s trademarks, logos, Platform design, software, text and company-created content belong to the company or its licensors. Users receive a limited, revocable licence to use the Platform only for authorised personal or business purposes. Copying, resale, reverse engineering and derivative use are prohibited unless authorised or permitted by law.
Privacy
Data processing is governed by the Privacy Policy included with these Terms and published on the Platform. A Service Provider’s use of Customer data outside Booking instructions is the provider’s independent responsibility. All users must apply appropriate safeguards and must not disclose another person’s data improperly.
Suspension and Termination
We may suspend, restrict or terminate an account for a Terms breach, reasonable fraud or security concerns, repeated cancellations or serious complaints, expired licensing or a competent authority request. Where circumstances permit, we will explain the reason and allow the user to submit clarification or an objection.
A user may request account closure. Existing Booking, payment, dispute and lawful data-retention obligations survive closure, and closure does not waive previous amounts or rights.
Third-Party Services
Some features depend on independent payment, map, messaging, login or analytics providers. Their services are governed by their own terms. The Gala is not responsible for their interruption, credit decisions or content, except where liability is required by law or the issue results from The Gala’s own failure.
Platform Availability
We aim to keep the Platform available, but maintenance, faults or events outside reasonable control may occur. We may update features or discontinue non-essential functions. We do not promise an error-free service, but will use reasonable care to address faults that materially affect bookings or payments.
Limitation of Liability
To the extent permitted by law, The Gala is not liable for indirect loss or lost profit caused by an independent act of a Service Provider, Customer or third party. Nothing excludes liability for fraud, gross negligence, death or personal injury caused by negligence, consumer rights or any liability that cannot legally be excluded.
If The Gala is held liable for a Booking-related claim, liability is assessed by reference to proven direct loss and the Platform’s actual role. Any limitation must be interpreted without reducing mandatory rights.
Indemnity
To the extent permitted by law, a user or Service Provider is responsible for losses and claims caused by its breach of these Terms, law or third-party rights, or by its data, content or services. This does not apply to loss caused by The Gala’s own fault. The affected party must be notified and given a reasonable opportunity to defend or settle the claim.
Force Majeure
A party is not liable for delay or failure directly caused by an event outside reasonable control, such as a disaster, government action, widespread service interruption or epidemic, provided it gives notice and takes reasonable steps to mitigate. The parties will cooperate on rescheduling, cancellation and refunds according to law, the Booking Policy and the nature of unconsumed amounts.
Complaints and Disputes
Please first submit complaints to [email protected] or telephone or WhatsApp 920031594, quoting the Booking number and providing supporting documents. We acknowledge receipt and seek to resolve complaints within a reasonable period and applicable statutory timelines. We may request evidence from both parties and hold settlement of a disputed amount where needed.
If an amicable solution is not reached, each party retains the right to contact the Saudi Ministry of Commerce or another competent regulatory or judicial authority. These Terms do not restrict any statutory complaint right.
Electronic Notices
Users agree to receive account and Booking notices by app, email, SMS or WhatsApp using registered contact details. A notice is treated as received when sent to a valid channel unless delivery failure is shown. Users must keep contact details current. Marketing may be disabled without disabling necessary operational messages.
Changes to These Terms
We may amend these Terms to develop the service or comply with law. The new version and effective date will be published, with appropriate advance notice of material changes where possible. Changes do not apply retrospectively to a confirmed Booking unless they benefit the user, are legally required or are accepted. Provider-specific commercial changes follow the notice mechanism in the relevant agreement or TheGala Partner.
Assignment
A user may not transfer an account, Booking or related rights without consent unless the Offer policy allows it. The company may transfer its rights and obligations to an affiliate or legal successor in a reorganisation or acquisition, provided statutory user rights are not reduced and appropriate protection continues.
Governing Law and Jurisdiction
These Terms are governed by the laws of the Kingdom of Saudi Arabia. Saudi competent authorities and courts have jurisdiction over disputes not resolved amicably, subject to mandatory consumer rights and jurisdiction rules.
General
If a provision is invalid or unenforceable, the remaining Terms remain effective and the provision will be replaced to achieve its purpose within legal limits. Failure to exercise a right is not a waiver. These Terms, the Privacy Policy, the displayed Booking Policy and any applicable Service Provider Agreement form the complete agreement for their respective subject matter.
